These Terms of Service (“Terms”) govern your use of the Can Crush mobile application and the website at cancrush.ai (together, the “Services”) operated by Can Crush LLC (“Can Crush,” “we,” “our,” or “us”).
By creating an account or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us promptly at support@cancrush.ai if you suspect unauthorized access. We are not liable for any loss resulting from unauthorized account use that you fail to report.
One person, one account. You may not create accounts using automated means or transfer your account to another person.
Can Crush is a recreational application that measures the diameter of crushed aluminum beverage cans from user-submitted images using a standard payment or ID card as a scale reference, with global, country, and regional leaderboards, friends, competitions, and the Can Crush STOMP arcade mini-game.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You will not:
You retain ownership of photos and content you submit to Can Crush (“User Content”), subject to the rights you grant below.
By submitting User Content, you grant Can Crush a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display your User Content as needed to operate, improve, and provide the Services, including leaderboard, sharing, and challenge features. This license ends when you or we delete your User Content, except for backups and to the extent retention is required by law.
You represent that you have the rights needed to submit User Content and that your submission does not violate third-party rights, including privacy, publicity, or intellectual property rights.
Can Crush provides tools to report content and users. We review reports and may take moderation actions, including content removal, leaderboard adjustments, account restrictions, or account termination, when content or behavior violates these Terms, applicable law, or our content policies.
Competitions and challenges are optional. You participate at your own risk. Do not engage in unsafe, reckless, or unlawful behavior when participating. You are responsible for ensuring your participation environment and actions are safe and appropriate.
We may end, suspend, modify, or void any competition at our discretion, including for technical failure, suspected fraud, or abuse.
The Services include advertising delivered by Google AdMob and similar providers. Ads support free access to the Services. Subject to your device’s tracking-permission settings, ad networks may use device advertising identifiers to show relevant ads.
“Can Crush,” “Can Crush STOMP,” the Can Crush logo, and the visual design of the Services are trademarks and trade dress of Can Crush LLC. You may not use these marks without our prior written permission, except to refer to the Services in a way that does not suggest endorsement.
You may stop using the Services at any time and may delete your account from inside the app or via our Account Deletion page.
We may suspend or terminate your access to the Services, without notice, if we reasonably believe you have violated these Terms, created risk or possible legal exposure for Can Crush, or for any other reason at our discretion. Upon termination, your right to use the Services ends immediately. Sections of these Terms that by their nature should survive termination will survive.
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Can Crush disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that measurement results will be free from variation or error.
To the maximum extent permitted by law, in no event will Can Crush, its affiliates, officers, employees, or agents be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with the Services. Our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) U.S. $100.
You agree to defend, indemnify, and hold harmless Can Crush LLC and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Services, your User Content, or your violation of these Terms or any third-party rights.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. You and Can Crush agree to submit to the exclusive jurisdiction of the state and federal courts located in Allegheny County, Pennsylvania, for any dispute arising out of or relating to these Terms or the Services, except where prohibited by applicable law.
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Material changes will be communicated through an in-app notice or email when reasonably possible. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
